The short version, in plain words.
The full text below is what legally applies. Reading the short version is not the same as reading it.
These Terms of Use ("Terms") are an agreement between you and the individual operator of VibeLift ("VibeLift", "we", "us"), a private individual resident in the Republic of Serbia, reachable at support@thevibelift.com. VibeLift is the web application published at vibelift.vercel.app, together with any app installed to your phone's home screen from it.
By creating an account, ticking the acceptance box, or using VibeLift in any way, you confirm that you have read, understood and accepted these Terms and the Health and Safety Disclaimer in section 2. If you do not accept them, do not use VibeLift.
If we learn that an account belongs to someone under 18, we may delete it without notice.
Nothing in VibeLift is medical advice, diagnosis, treatment, physiotherapy, rehabilitation guidance, nutritional advice, or a personalised training programme. No doctor, physiotherapist, dietitian or certified trainer has reviewed the content for your body, your history or your condition. No professional relationship of any kind is created between you and us by your use of the app.
Consult a physician before beginning, changing or resuming any exercise programme, and in particular if any of the following apply to you: heart disease or a heart murmur; high or low blood pressure; chest pain; dizziness or fainting; diabetes; asthma or any breathing condition; epilepsy; joint, bone, disc, tendon or muscle problems, past or present; any surgery; any hernia; osteoporosis; an eating disorder; pregnancy, recent childbirth or postnatal recovery; any current medication; any illness or injury of any kind; or if you are over 45 and have not exercised regularly. This list is an example, not a complete list.
Resistance training, bodyweight training and every other activity that VibeLift can be used to record carry an inherent and unavoidable risk of injury, including catastrophic injury, permanent disability, heart attack, stroke and death. That risk exists even with perfect technique, correct equipment and full supervision. You accept that risk knowingly and voluntarily every time you train.
Exercise names, categories, muscle groups, illustrations, animation frames, equipment labels and step-by-step instructions inside VibeLift are illustrative simplifications. They are compiled and drawn with the help of automated tools. They may be inaccurate, out of date, mislabelled, incomplete, unsafe for your body, or may show a movement incorrectly. They are not a substitute for instruction from a qualified trainer who can see you move.
Before performing any exercise you find in VibeLift, you are responsible for verifying it independently with a qualified professional. Do not perform an exercise because the app showed it to you. If a picture or instruction in the app contradicts what a qualified person has told you, follow the qualified person, not the app.
Reports of a wrong or unsafe exercise are welcome at support@thevibelift.com. We will correct what we can, but we do not promise that the content is or will become accurate or complete.
VibeLift does not watch you, does not assess your technique, does not know your injuries, does not adjust anything for your condition, and cannot tell when something is going wrong. Weight selection, repetition count, rest, progression, warm-up, equipment setup, machine adjustment, collar and clip use, spotters, safety pins and bars, floor surface, gym rules and the decision to attempt any lift are entirely yours.
Stop immediately and seek medical attention if you feel pain, pressure or tightness in the chest, arm, neck or jaw; breathlessness out of proportion to the effort; dizziness, faintness or blurred vision; nausea; sudden or sharp joint or muscle pain; numbness or tingling; or anything else that feels wrong. In an emergency call your local emergency number. VibeLift has no emergency function and nobody is monitoring the app.
To the fullest extent permitted by law, you assume all risk arising out of your physical activity and your use of VibeLift, and you release, waive and agree not to sue VibeLift, its operator, and anyone who contributed content or code to it, in respect of any injury, disability, death, illness, aggravation of an existing condition, property damage or loss suffered by you or by anyone claiming through you and connected with your use of the app or any exercise recorded, planned, suggested, illustrated or described in it, including where that loss is said to arise from inaccurate, incomplete or unsafe content in the app.
To the fullest extent permitted by law, you agree to indemnify and hold harmless VibeLift and its operator against any claim, demand, proceeding, loss, damage, fine, cost or expense (including reasonable legal fees) brought by a third party and arising out of your use of VibeLift, your breach of these Terms, or your training activity.
VibeLift is a personal project run by one person in his free time. It is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law.
We do not promise that:
We may change, suspend, limit or discontinue VibeLift, in whole or in part, at any time and without notice.
Your workouts are stored on your device and, if you sign in, in a hosted database operated by third-party providers. Data can be lost. Causes include browser storage being cleared, private browsing, device loss or reset, sign-in problems, provider outages, bugs, or an account deletion request. To the fullest extent permitted by law, we are not liable for lost, corrupted or unrecoverable data. Keep your own record of anything you cannot afford to lose.
New accounts get a free trial of 30 days, counted from the moment the account is created. No payment details are asked for at the start of the trial. The trial belongs to the account, not to the device, so signing in on another phone does not restart it. One trial per person.
When the free trial ends, VibeLift stops working until a one-time payment of EUR 8 is made. Your workout history is not deleted and is waiting for you when you pay. You may also delete your account and take your data with you instead — see section 5.
You are buying directly from the operator of VibeLift. PayPal processes the payment under PayPal's own terms; it is the payment processor, not the seller. We never see or store your card details — they are handled entirely by PayPal.
Any VAT or other tax due on your purchase is our responsibility to account for, not yours, and the price you see at checkout is the final amount. A receipt is issued to the email address on your account. If you need a formal invoice with your details on it, ask us and we will send one.
PayPal is currently the only payment method. If you cannot use PayPal, write to us before paying.
If you are a consumer in the European Union, the European Economic Area or the United Kingdom, you have a legal right to withdraw from this purchase within 14 days, without giving any reason.
Because this is digital content delivered immediately, the law lets you trade that right away in exchange for instant access. At checkout you will be asked to confirm that you want access to start immediately and that you accept you lose the 14-day withdrawal right once it does. You do not have to agree. If you do not, access begins after the 14 days instead.
Regardless of the above, we will refund you in full within 14 days of purchase if you ask. Write to support@thevibelift.com from the email address on the account. No reason needed, no argument. Your access ends when the refund is issued.
Later refunds are not automatic, but we would rather sort out a real problem than keep money from someone who cannot use the app. Write to us. Nothing in this paragraph limits any refund right you have by law.
If a payment is reversed, charged back or found to be fraudulent, we may suspend access to the account until it is resolved. Creating extra accounts to obtain repeated free trials is a breach of these Terms and those accounts may be closed.
EUR 8 buys access for as long as the app exists. We cannot promise it exists forever. If we shut VibeLift down permanently, we will give notice in the app and let you export your workout data first. A payment made within the 90 days before the shutdown announcement will be refunded on request.
VibeLift runs on, and sends data through, services operated by other companies — hosting, database and authentication, font and script delivery, email delivery, visit counting (Google Analytics, only if you allow it), and the payment provider. Their availability, security and terms are outside our control, and we are not liable for their acts or omissions. See the Privacy Policy for what data goes where.
The VibeLift name, interface, code, illustrations and written content belong to the operator or are used with permission. You get a personal, non-exclusive, non-transferable, revocable licence to use the app for your own training. Your workout data stays yours.
To the fullest extent permitted by applicable law:
What we do not try to exclude. Nothing in these Terms excludes or limits liability for death or personal injury caused by our own negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. If you are a consumer, your mandatory rights under the consumer law of your country of residence are unaffected by these Terms, and nothing here removes them.
If a court finds any provision of these Terms invalid or unenforceable, that provision is limited or removed to the minimum extent necessary, and the rest stays in force.
We may update these Terms. The "last updated" date at the top changes when we do. Material changes will be shown in the app the next time you open it. Continuing to use VibeLift after a change means you accept the updated Terms. If you do not accept them, stop using the app and delete your account.
These Terms are governed by the law of the Republic of Serbia, and the courts of Belgrade have jurisdiction. If you are a consumer resident in the European Union, the European Economic Area or the United Kingdom, this does not deprive you of the protection of the mandatory consumer rules of your country of residence, and you may also bring proceedings in the courts of your own country.
Before going to court, please email us. Most things are a misunderstanding and take five minutes to fix.
